After an appeals court gave the Trump administration a green light, President Trump said Thursday that the administration is moving forward on a program to withhold funding from sanctuary cities, which is part of a larger push to end policies that have pitted local jurisdictions against federal immigration authorities, often times with fatal consequences.
The 2nd U.S. Circuit Court of Appeals in Manhattan ruled in favor of the administration and said that the funding cuts were valid.
The blocked funds are Justice Administration Grants, or JAG grants that are typically awarded to law enforcement jurisdictions.
The ruling affects grants awarded to states, cities and other jurisdictions that refused to cooperate with agencies such as Immigration and Customs Enforcement (ICE) and Customs and Border Control (CBP).

The Trump administration has taken a hard line toward illegal immigration, and so-called “sanctuary” jurisdiction are typically those run by Democrats who oppose the president on seemingly everything.
Author note: Trump could find a cure for cancer and the Democrats would complain that he’s putting oncologists out of business, such is their disdain for the president.
Since he was sworn into office, the president has tried to use federal grants as a sledgehammer in order to pressure those sanctuaries to cooperate with federal law enforcement agencies, however he has been continually challenged in court.
While the 2nd Circuit ruled in favor of the administration, at least three other federal appeals courts have ruled against blocking these funds, which sets the issue up for a possible appeal to the United States Supreme Court.
Perhaps if it does that would give Senate Minority Leader Chuck Schumer another reason to go off the rails like he did on Wednesday when he threatened two Supreme Court Justices, Neil Gorsuch and Brett Kavanaugh.
In announcing that the administration was moving forward, the president said:

In the 2nd Circuit Court ruling, they overturned a lower court ruling that stopped the 2017 move by the administration to withhold grant money from the Edward Byrne Memorial Justice Administration Grant program, which dispenses over $250 million a year to state and local criminal justice efforts.
After the administration moved to block the grants, New York City and liberal states, including New York, Washington, Massachusetts and Connecticut sued the government, and the U.S. District Court for the Southern District of New York backed them—ordering the money released and stopping the government from imposing immigration-related conditions on grants.
However, the appeals court disagreed, stating that it “cannot agree that the federal government must be enjoined from imposing the challenged conditions on the federal grants here at issue.”
Sanctuary policies basically block local cooperation with immigration authorities and bar law enforcement from complying with ICE detainers—which are requests that ICE be alerted when an illegal “immigrant” is being released from local custody.
Left wing proponents of sanctuary cities ignore the fact that a number of those arrested and released who are subject to detainers end up committing additional, sometimes more serious crimes.
They say that such policies make communities safer by encouraging illegal “immigrant” victims of crime or witnesses to cooperate with law enforcement.
“The Trump administration’s scare tactics destroy trust in law enforcement. The day our police ask for immigration status is the day people stop reporting crimes and sharing information.
It’s the day we stop being the safest big city in America. We won’t let that happen,” New York Mayor Bill de Blasio said, apparently with a straight face, in January.
This after New York City and its suburbs were the scene of a number of anti-Semitic attacks which left Jewish residents in the city in fear for their safety. Safest big city, huh de Blasio?
Administration officials responded to de Blasio and other illegal “immigrant” enablers by pointing to a number of cases when an illegal immigrant was released from custody despite a detainer, and who went on to commit another crime.

Last month, Acting ICE Director Matt Albence, in a letter to de Blasio, noted that ICE’s New York City Enforcement and Removals Office issued detainers on 7,526 subjects who had criminal histories, including 3,500 assaults, 1,500 DUIs, 1,000 sex crimes, 1,000 weapons offenses, 500 robberies and 200 homicides.
In February, the administration announced that they were going to have elite Border Patrol agents deployed in sanctuary cities to help ICE track down and detain illegal immigrants. This of course was met with mass hysteria by the loony left. Trump plays chess while they play tiddlywinks.
The Justice Department recently announced a slew of measures, and Trump has asked Congress to pass legislation that would allow victims of crimes committed by illegal “immigrants” to sue sanctuary cities and states.
Last month, Attorney General William Barr, speaking at the National Sheriff’s Association 2020 Winter Legislative and Technology Conference in Washington, D.C., he said that the Justice Department would be immediately filing multiple lawsuits against sanctuary jurisdictions for unconstitutionally interfering with federal immigration authorities, and would implement unprecedented reviews of left-wing sanctuary governments and prosecutors.
“Let us state the reality upfront and as clearly as possible,” Barr stated. “When we are talking about sanctuary cities, we are talking about policies that are designed to allow criminal aliens to escape. These policies are not about people who came to our country illegally but have otherwise been peaceful and productive members of society. Their express purpose is to shelter aliens whom local law enforcement has already arrested for other crimes. This is neither lawful nor sensible.”
The DOJ filed a federal complaint against the State of New Jersey seeking both declaratory and injunctive relief “against its laws that forbid state and local law enforcement from sharing vital information about criminal aliens with DHS,” Barr said.
Furthermore, Barr said, “we are filing a complaint seeking declaratory and injunctive relief against King County, Washington, for the policy that forbids DHS from deporting aliens from the United States using King County International Airport.”
This suit says in part that the “executive order unconstitutionally conflicts with the federal Airline Deregulation Act, which “prohibits localities such as King County from enacting or enforcing laws or regulations that relate to prices, routes, or services of air carriers,” the DOJ said. The order has forced ICE to transport detainees to Yakima, Washington, which has dramatically increased the operating costs for ICE.
DOJ is also targeting certain district attorneys, such as Acting Brooklyn District Attorney Eric Gonzalez who have adopted policies of charging foreign nationals with lesser offenses for the express reason of avoiding the federal immigration consequences of those nationals’ criminal conduct.
One of the more serious cases and one which gained a lot of national attention was the case of an illegal “immigrant” who was arrested for assaulting his father in New York.
“In November, ICE filed a detainer for an alien who was arrested for assaulting his own father,” Barr said. “The local police in New York City that had the alien in custody ignored the detainer. So, the alien was released onto the streets, and last month [December], he allegedly raped and killed 92-year-old Maria Fuertes, affectionately known as ‘abuelita’, a fixture of her Queens neighborhood.”
These are the people liberals want to protect. Remember that. Thank God at least one court gets it.
