‘He should be punished’: Sen. Rand Paul seeks criminal charges against Fauci for lying to Congress


WASHINGTON, D.C. – Senator and physician Rand Paul (R-KY) announced on Tuesday, July 20, that he will be referring Dr. Anthony Fauci, director of the U.S. National Institute of Allergy and Infectious Diseases and the chief medical advisor to the president, for criminal investigation because Fauci allegedly lied to Congress about his involvement with gain of function research in China.

Paul made this announcement while appearing with Fox News Channel’s Sean Hannity on Tuesday night to discuss a contentious conversation with Fauci that occurred at a Senate Committee on Health, Education, Labor & Pensions hearing Tuesday morning.

At that hearing, Paul referred to Fauci’s previous statement before Congress on May 11, 2021, in which Fauci unequivocally denied involvement by the NIH with gain of function research, or biological research that evaluates ways to modify viruses, potentially making them more potent and dangerous.

At that time, Fauci declared:

“Sen. Paul, with all due respect, you are entirely, entirely and completely incorrect … the NIH has not ever and does not now fund gain of function research in the Wuhan Institute.”

He continued:

“I don’t favor gain-of-function research in China.”

Reminding Fauci of his statement in May, Senator Paul stated at Tuesday’s hearing:

“Dr. Fauci, as you are aware it is a crime to lie to Congress.  Section 1001 of the U.S. Criminal Code creates a felony and a five-year penalty for lying to Congress.”

He continued:

“[G]ain of function research was done entirely in the Wuhan Institute by [Chinese virologist] Dr. Shi, and was funded by the NIH.”

Paul went on to cite a paper written by Dr. Shi, in which she credited the NIH.

He stated:

“In this paper, she took two bat coronavirus genes, spiked genes, and combined them with a SARS-related backbone to create new viruses that are not found in nature.

“These lab-created viruses were then to (sic) shown to replicate in humans.

These experiments combine genetic information from different coronaviruses that infect animals but not humans to create novel artificial viruses able to infect human cells. Viruses that in nature only infect animals, were manipulated in the Wuhan lab to gain the function of infecting humans. 

“This research fits the definition of the research that the NIH said was subject to the pause in 2014 to 2017 — a pause in funding on gain of function. But the NIH failed to recognize this… and it never came under any scrutiny.”

In addition, Paul also cited Dr. Richard H. Ebright, a molecular biologist from Rutgers, who stated that the Wuhan research, funded by the NIH, “matches, indeed epitomizes, the definition of gain of function research.”

Pinning Fauci down further on his previous statement in May, Paul then asked:

“Dr. Fauci, knowing that it is a crime to lie to Congress, do you wish to retract your statement of May 11 where you claimed that the NIH never funded gain of function research in Wuhan?”

In a fiery conversation that followed, Fauci refused to backpedal on his statement or admit to lying, saying:

“Senator Paul, I have never lied before the Congress and I do not retract that statement.

“This paper that you were referring to was judged by qualified staff up and down the chain as not being gain of function.”

He testily added:

“Senator Paul, you do not know what you are talking about, quite frankly, and I want to say that officially.  You do not know what you are talking about.”

Paul countered:

“This is your definition [of gain of function] that you guys wrote.  It says that scientific research that increases the transmissibility among animals is gain of function. 

“They took animal viruses that only occur in animals, and they increased their transmissibility to humans.  How you can say that is not gain of function?“

Fauci replied:

“It is not.”

Paul continued with a pointed comment, saying:

“It’s a dance, and you’re dancing around this because you’re trying to obscure responsibility for four million people dying around the world from a pandemic.”

The Senator added later to a sputtering Fauci:

“All the evidence is pointing that it came from the lab, and there will be responsibility for those who funded the lab, including yourself.”

In an ensuing and contentious back-and-forth, Fauci accused Paul of lying, while Paul continued to remind Fauci that the NIH-funded research at the Wuhan lab met Fauci’s own definition of gain of function research, adding that it was Fauci who was “obfuscating the truth.”

Reviewing this heated exchange with Fauci on Fox with Sean Hannity Tuesday night, Paul stated:

“I think the reasoning behind [Fauci] being so resistant, so livid, and so full of ad hominem, is he realizes that once the public realizes that the NIH under his leadership funded the Wuhan lab, that is beyond question they did, the NIH funded the lab, but once the public figures out that they were doing very, very dangerous research there, gain of function research… he realizes where the blame’s going to attach.


Paul continued:

“He has at least tangential responsibility.  If this came from the lab that he was funding, my goodness, can you imagine the moral culpability the man has?”

Turning to the subject of Fauci’s lying to Congress, Hannity asked:

“You kicked off your questioning of Dr. Fauci emphasizing federal law makes lying to Congress a felony punishable by up to five years in prison.

“Is it your belief based on the evidence, Senator, that he lied before Congress and broke the law?

Senator Paul replied:

“Yes, and I will be sending a letter to the Department of Justice asking for a criminal referral because he has lied to Congress. We have scientists that were lined up by the dozens to say that the research he was funding was gain of function.

“He’s doing this because he has a self interest to cover his tracks and to cover his connection to Wuhan lab.

Paul continued:

“Now does he deserve all the blame? No, there’s still some conjecture as to whether or not it came from the lab. 

“But he’s lying about whether or not he funded gain of function research, and yes, he should be punished.”

Sen. Rand Paul: I’m sending Hunter Biden Report to the DOJ for criminal referral

WASHINGTON D.C. – Looks like the October surprise came in September.

On Wednesday, September 23rd, Senator Rand Paul (R-KY), was interviewed on Fox News Channel’s “The Story”, where he revealed that he will be sending the Senate Homeland Security and Finance Committees’ preliminary report on Hunter Biden’s business dealings to the Department of Justice, and will ask for a criminal referral.

Paul said:

“I think riding on Air Force Two and doing business is illegal. I think that is against the law, and probably a felony. I think it’s illegal to take money from a Russian politician’s wife, $3.5 million. Was it reported accurately?”

Paul was referring to the new report that looked into the details of Hunter Biden’s role on the board of the Ukrainian natural gas firm “Burisma Holdings.”

The Senate committee revealed they had obtained records that:

“show potential criminal activity relating to transactions among and between Hunter Biden, his family, and his associates with Ukrainian, Russian, Kazakh and Chinese nationals.”

Paul continued:

“I think the only way to determine the actual legality of this is to have it referred to the Department of Justice. So, I’m going to send the report over. I don’t know if the whole committee will vote for it, but I’m sending the report, tomorrow, to the Department of Justice, and we’re asking for a criminal referral.”

According to FoxNews, investigators also found millions of dollars in “questionable financial transactions” between Hunter Biden and his associates and foreign individuals, including the wife of the former mayor of Moscow as well as individuals with ties to the Chinese Communist Party.


Senator Paul then went on to say that he wants to see “a criminal investigation that’s justified.”

He said:

“Here is this evidence, look at it, and then you as the lawyers for the government decide if you have enough to prosecute,” he said, “but I think we should refer this for a criminal investigation.”
