Report: Dems using court-packing threat to intimidate SCOTUS from overturning Roe v. Wade


The following editorial is written by a retired Police Chief and current staff writer for Law Enforcement Today.

WASHINGTON, DC- One thing we’ve seen from Democrats. When they don’t like it when they don’t get their way, they act like petulant children and instead of taking their licks and moving on, they seek to change the rules of the game.

They are a party who somehow think in November 2020 they received a mandate to run roughshod over the country, even as they have a 50/50 tie in the Senate and control the House by a handful of seats.

A current example surrounds the abortion issue currently under consideration by the Supreme Court. Democrats and their sycophants in the mainstream left-wing media are in a full-court press to intimidate the Supreme Court to “play nice” when it comes to actually ruling in favor of the United States Constitution, which is their job.

Unlike most Republicans, Democrats view the court as a quasi-extension of Congress, where laws are enacted which don’t pass muster in the legislative process.

An example of that is Obamacare, where Chief Justice John Roberts conducted some judicial Jenga and declared it to be a tax.

The latest act from Democrats and their media mouthpieces is to hold “packing” of the Supreme Court over the heads of justices if they don’t play nice. In this case, that means not touching Roe v. Wade.

You see, Democrats do not consider the judicial branch to be a separate but equal, independent branch of the federal government.

They look at it as a means to push through issues such as abortion on demand, which is mentioned nowhere in the Constitution (and only engaging in some creative verbal gymnastics can even get you there), yet that has been the law of the land for some 50 years.

As noted in a piece in Breitbart, Democrats, unhappy with merely controlling 2/3 of the federal government want their grubby paws on the third, the judicial branch.

They want to take our democratic republic and turn it into a quasi-dictatorship, where any semblance of checks and balances disappears.

Indeed, the current threat of Democrats to mess with the high court was actually addressed back in the 1700s by James Madison in Federalist 51.

He wrote that the essence of our republican system of government “consists in giving to those who administer each [branch], the necessary constitutional means, and personal motives, to resist encroachments of the others.” Madison virtually predicted exactly what Democrats are undertaking 234 years hence.

None of that appears to matter to Democrats, unhappy with merely controlling 2/3 of the federal government. As Barack Obama reminded us several years ago, elections have consequences.

Taking the sage advice of president cool, the 2016 election did have consequences—former President Donald Trump getting to appoint three justices to the Supreme Court—Neil Gorsuch, Brett Kavanaugh, and Amy Coney-Barrett.

Those appointments translated into Republican presidents having appointed six justices to the high court, Democrats three. However for the most part and with limited exceptions, that hasn’t translated to any clear victories for conservative priorities.

One need only look at the Court’s refusal to consider what many believed to be slam-dunk cases relative to the 2020 election to realize Democrats’ whining about the court is absurd.

Of course, certain cases trigger the left more than others, none more so than Roe v. Wade. Abortion is the holy grail of leftist causes and nothing to them is more sacred than having the ability to murder unborn babies at will.

A current case being examined by SCOTUS is Dobbs v. Jackson Women’s Health Organization, which was argued before the court on December 1.

This is a key case which examines whether or not the 1973 Roe v. Wade case was properly decided. In essence, no matter what side of the issue you fall on, this case would appear to be extremely important. And that has the pro-abortion crowd in a tizzy.

For liberals, the issue that they live and breathe for (along with “climate change) is thought by some to be hanging by a thread. Or at least, that’s what the mainstream leftist media is parroting, likely in an attempt to fire up the far-left base. Here are some headlines Breitbart noted:

“Roe v. Wade is Probably Doomed” in Bloomberg; Vox wrote “It sure sounds like Roe v. Wade is doomed”, and “Prepare for a post-Roe v. Wade reality,” CNN breathlessly wrote when it wasn’t defending staffers from sex offense allegations.

With all of this in mind, the left is clearly trying to mobilize their base by instilling fear into them and using their willing accomplices in the mainstream media to play along.

There is a concerted effort occurring which is seeking to basically scare the Supreme Court from a decision which would either limit or eliminate Roe v. Wade.

Now, such an effort is likely to have zero effect on the rock-solid Constitutionalists on the court such as Justices Clarence Thomas, Samuel Alito, and Gorsuch. However the “squishy conservatives”—Kavanaugh, Coney Barrett and especially Roberts may be able to be swayed by such talk.

After all, being one of nine is much more palatable than one of eleven, or thirteen.

Democrat senators also in some cases are looking to change the balance of the court, with a December 3 headline in the Washington Post reading, “More Democratic senators are willing to weigh changes to Supreme Court.”

At the beginning of the article, it read, “This week’s Supreme Court argument on abortion has accelerated an urgency among Senate Democrats to fundamentally alter how the court operates.”

Still, the way West Virginia Sen. Joe Manchin was treated by the White House and fellow Democrats this week after he refused to back Biden’s inflation accelerating “Build Back Better” plan it is questionable if he would go anywhere near an attempt to pack the Supreme Court.

According to the Post, one move under consideration include increasing the number of justices on the court from the current number of nine. The article notes that a “growing faction” of Democratic senators “say they are now prepared to consider such moves.”

All of this of course equates to a fool’s errand because any move by, say a Democrat-controlled senate to expand the justices to eleven could be met by a subsequent move by a Republican-controlled senate to increase the makeup to thirteen. It’s foolish. But then again, that’s how Democrats roll.

For example, on December 15, Sen. Elizabeth Warren (D-MA) took time off from her personal attacks on Elon Musk to express support for increasing the high court to thirteen justices:

“I come to this conclusion because I believe the current Court threatens the democratic foundations of our nation.”

That of course is code (or smoke signals, if you will) for Warren’s true meaning…she wants a Democratic-appointed majority on the court.

A decision in the Dobbs isn’t expected until June, so there is adequate time in the next six months or so for Democrats and their media mouthpieces to trumpet the “packing the court” cattle call.

The idea of packing the court however isn’t anything new. During the presidential primaries in 2020 a number of Democrats vying for that party’s nomination floated the idea of court-packing, including now-vice president cackling Kamala Harris.

In a not-so-shocking development, then-candidate Joe Biden came out during the campaign in opposition to court-packing. However, once he was in office, Biden created a commission tasked with studying the Supreme Court, including the “membership and size of the Court.” That commission actually came out against any type of court packing.

On December 6, the commission came out with no recommendation on packing courts, although some considerations floated were term limits for justices, which would in essence give each president the opportunity to appoint at least one justice, Breitbart reported.

That’s not to mean all those on the commission opposed the idea of court packing. One such member, Nancy Gerner of (surprise, surprise) Harvard Law School said the following as quoted in the New York Times:

“This is a uniquely perilous moment that requires a unique response. Whatever the costs of expansion in the short term, I believe, will be more than counterbalanced by the real benefits to judicial independence and to our democracy.”

And it will protect the sacred cow of abortion.  

Talk of expanding the Court isn’t limited to the Senate, with House Judiciary Committee chairman Jerrold Nadler (D-NY) proposing an increase to thirteen justices, as Warren had suggested. That is liberal Democrats for you…if you don’t like the outcome of the game, change the rules.

The Dobbs case has liberals apoplectic, so much so that in September, Deputy Press Secretary Karine-Jean Pierre mumbled through a White House press conference, telling those in attendance that so concerned was the White House about the possible outcome of the case that the White House Gender Policy Council was asked about possible options which could be taken by Biden:

And so, on the table, we’re looking at legislative actions—what are the best legislative actions, what are the actions that the administration itself can do. [Biden] wants to see action and remains committed to that.

Remember…Biden is a “devout Catholic.” Catholics are supposed to be opposed to abortion. But for Democrats, their religion is abortion and Biden, as a good liberal before being a good Catholic is committed to protecting the holy grail.

Dobbs of course isn’t the only hot-button issue facing the Court, with cases involving gun control, affirmative action and religious education all slated to be heard by the Court.

CNN legal analyst and Zoom call masturbator Jeffrey Toobin is very concerned about the alleged conservative-leaning Supreme Court, saying on December 10:

“The Supreme Court may yet address affirmative action…the conservatives have wanted to end affirmative action. Conservatives have wanted to expand the understanding of the Second Amendment to ban most forms of gun control,” Toobin said.

“These are all issues where the Supreme Court appears to be making radical changes in what our understanding of the Constitution means.”

Affirmative action and gun control…two other sacred cows of the loony liberal left.

Some, however have come out harshly against any movement to alter the makeup of the court, including George Washington University law professor Jonathan Turley, a brilliant mind in the world of jurisprudence who referred to Warren’s proposal as “perfectly Orwellian,” a reference to George Orwell’s dystopian classic “1984.”

This is of course not the Democrats’ first foray into court packing, having long tried to use the “nuclear option” when they don’t get their own way.

The most recent example prior to now was in 1937 by then-President Franklin D. Roosevelt. Fresh off a landslide victory in the 1936 election, Roosevelt was likely feeling his oats, especially with overwhelming Democrat majorities in the House and Senate.

Roosevelt had been stymied during his first term because, although two-thirds of the government was in the hands of Democrats, there was then, as there is now, a conservative majority on the Supreme Court.

Roosevelt was frustrated because key parts of his New Deal had been torpedoed by the Court, including the National Industrial Recovery Act which was found to be unconstitutional.

In a nationwide radio address on March 9, 1937, Roosevelt expressed his frustration with the Court:

Last Thursday, I described the American form of Government as a three horse team provided by the Constitution to the American people so that their field might be plowed. The three horses are, of course the three branches of government—the Congress, the Executive, and the Courts. Two of the horses are pulling in unison today; the third is not.

Roosevelt’s solution? Expand the court to as many as fifteen justices. This should prove an easy task, given the Democrats’ overwhelming majorities.

However the American people grew wary of Roosevelt’s power play. He was an elected president, not  a monarch. Roosevelt’s plan was aptly described as court packing, and public opinion soon took hold and it wasn’t in his favor.

Many Democrats started to come out against Roosevelt’s plan, including some of the leading voices in that caucus.  

Even his vice-president refused to back him up in the effort, and even the liberal leader of the Court came out in opposition to the plan.

Less than six months later, the idea was dead in the water.

While Roosevelt’s plan didn’t succeed at least in adding numbers, it did accomplish something else. It intimidated the Court, which in Roosevelt’s second term, after his court-packing idea was floated, the Court began to change course, routinely approving Roosevelt’s New Deal proposals. In other words, he “won by losing.”

Or, as one law professor, John Q. Barrett said at the time, FDR “’lost the battle’ but nonetheless ‘won the war’ against the Supreme Court.”

If there is one thing we have learned over the past several years, as Breitbart notes, Chief Justice John Roberts is a political animal. His verbal judo in the Obamacare case is a clear example of Roberts sticking his finger into the political winds and formulating his opinion based on that.

As many noted after the Obamacare decision, which was decided by Roberts’ vote, he likely didn’t want “his court” to be the one which stuck a fork in Obama’s signature legislation. Some indications are that Roberts is possibly already starting to bend a little on some issues. We shall see.

With all of that in mind, two Republican senators, Deb Fischer of Nebraska and Marco Rubio of Florida have produced a brainstorm…enact a constitutional amendment to permanently assign a number of nine Supreme Court justices.

Such an amendment would eliminate games such as those proposed by Democrats to pack the court, and forever memorialize “Madison’s vision of a separate and distinct judicial branch.”

“You hear the 911 calls where people are calling in the middle of a riot in Atlanta, and they say, we’re really sorry but there are no police officers to send to your aid right now.  

“It’s disgusting.”

Taylor explained further that raising money is itself important, but the plans to raise awareness and share the truth with the public are equally significant.

He continued:

“I think it’s important to educate the public that there’s a problem….

“No matter how much money we raise in this effort, it’s also very important that we let the world know that the police need resources and they need money.”

Taylor added that a further advantage to educating the public would be to improve the reputation of law enforcement as a career.

He told us:

“We also need to try to re-engage young people to be police officers, because that used to be such a noble and admirable thing, and now it’s becoming so difficult to be a police officer, and to have young people aspire to be in law enforcement.

“We want to communicate to the world that it’s ok to be a cop.”

Taylor expanded further upon Sig Sauer’s ties with law enforcement, saying:

“It’s in our DNA…. We work closely [at Sig Sauer Academy] with military and law enforcement…. 

“It’s a big part of who our Academy personnel are; they are all current or former military and cops… and so they are such thought leaders for our company for both training and equipment and importantly, mindset.

He added:

Editor note: In 2020, we saw a nationwide push to “defund the police”.  While we all stood here shaking our heads wondering if these people were serious… they cut billions of dollars in funding for police officers.  And as a result, crime has skyrocketed – all while the same politicians who said “you don’t need guns, the government will protect you” continued their attacks on both our police officers and our Second Amendment rights.

UNITED STATES OF AMERICA – You back the Blue.  You support the police.  You quietly buy an officer a cup of coffee at your local coffeehouse.  You bring homemade cookies to your local police station.  You make it a point to thank an officer when you see one out in public.  

You watch the news, aghast to see crowds of anti-police protesters and rioters committing acts of violence and massive property damage.  You pray daily for the Blue family.

And yet, you may feel quite alone.

Politicians and the mainstream news media would have you think that police support is at an all-time low.

Some of you may have found it necessary to take down your Thin Blue Line flags from your house, or to scrape off the Thin Blue Line sticker from your vehicles, due to the potential for violent retaliation by those who hate the police.

Yes, it is the loudest voices that are the ugliest.  They revile and attack those who back the Blue.  They call, “Defund the Police!” at every turn, fueled by the lie that police officers are racists who are out to kill.

But you are actually in excellent company in your support of the blue family.

According to a Gallup poll, 85% of Americans support law enforcement.  That means supporters of the Thin Blue Line are 285 million strong.

That would be 285 million who, like you, refuse join in the calls to defund the police.

And that means you are in the company of those who have logic and reason on their side.

After all, we at Law Enforcement Today bring you stories daily of exploding crime in police-defunded areas such as Austin, Portland,  New York City, or Los Angeles.

Homicide rates since defunding are up 58% in Atlanta, up 533% in Portland, and up 37% in Philadelphia.

Shootings in post-defunded New York City are up 64%, and they are up 51% in Los Angeles and up 18% in Chicago.

In addition, you have also followed our disturbing and often tragic stories of attacks on police officers in the era of police defunding.

Felonious attacks on police are on the rise, as documented by the FBI’s Law Enforcement Officers Killed and Assaulted (LEOKA) Data Collection.  

According to LEOKA:

“The 50 law enforcement officers feloniously killed in the first 8 months of 2021 represent a 51.5 percent increase compared to the 33 officers killed during the same period in 2020.”

Also thanks to defunding, police departments across the country now lack training, resources, and equipment.  Ironically, calls for additional training in cultural awareness, de-escalation, and use of force often have to go unheeded due to the lack of financial resources.

Another irony is that the push to do away with less-lethal options such as Tasers and tear gas will simply lead to more fatal police shootings.

These alarming stories and statistics indicate beyond a doubt that defunding the police is absolutely the wrong move for this great country.  You know this, yet you and 285 million other voices are all too often silenced by social pressures as well as physical threats of violence.  

You are even told, “Silence is violence,” when it comes to refusing to stand against law enforcement.

Your voice matters, and you need to be heard.
