Fired white male executive wins ‘reverse discrimination’ lawsuit and get $10 million judgement

NORTH CAROLINA — A hospital fired a white male marketing vice president and replaced him with two women in order to allegedly boost its diversity efforts.

However, the plan backfired because the man sued his former employer and was ultimately awarded a $10 million “reverse discrimination” payout by a jury on Oct. 26.

 

According to Daily Mail’s report, in 2018 David Duvall sued Novant Health in North Carolina, where he worked for almost five years as the Senior Vice President of Marketing and Communications.

Duvall said he was inexplicably terminated just days before reaching his five-year work anniversary, a milestone that would have awarded him a higher severance payout than what he was given. He had worked for Novant since 2013 and was fired on July 30, 2018.

Duvall said he was replaced by two women — Kate Everett, a white woman who had worked with him and was promoted to take the role of Chief PR and Communications Officer and Vicky Free, a black woman who was given the role of Chief Marketing Officer.

In his complaint, Duvall said that while both women were qualified for the job, they were no more qualified than he was.

 

Attorneys for Duvall proposed that he was fired “out of the clear blue sky” because he was a white man, and that the move was in keeping with the hospital’s “five-year plan” to boost diversity by 2020.

Daily Mail further reported that Duvall’s complaint indicated that “the Chief Legal Officer, Medical Group President, Chief Information Officer, Patient Experience Officer and President of Haymarket Medical Center were all replaced either by a black person or a woman in the 12-18 months after him.”

In Duvall’s complaint, he said he regularly received excellent reviews from his superiors and that his team was always rated highly for their performance as well.

According to Daily Mail’s report, Novant denied the allegations and said he was fired for other reasons that were presented at the civil jury trial:

“In its original response to the lawsuit in 2019, Novant health said he was fired ‘due to his deficient performance, including his inability to communicate effectively before a group and the delegation of the critical duties of his position to his subordinates.’

“Novant says Everett was already doing much of Duvall’s job because he pawned it off to her, and that it was natural for her to be promoted. 

“It also denied his allegation that other men were fired for being white males, but didn’t go into detail about why they were replaced. 

“The jury sided with Duvall on Tuesday, awarding him the huge payout.”

In a statement to Daily Mail, the hospital wrote:

“We are extremely disappointed with the verdict as we believe it is not supported by the evidence presented at trial, which includes our reason for Mr. Duvall’s termination.

“We will pursue all legal options, including appeal, over the next several weeks and months.

“Novant Health is one of thousands of organizations to put in place robust diversity and inclusion programs, which we believe can co-exist alongside strong non-discriminatory policies that extend to all races and genders, including white men. 

“It’s important for all current and future team members to know that this verdict will not change Novant Health’s steadfast commitment to diversity, inclusion and equity for all.”

LET Unity

Luke Largess, Duvall’s attorney, told Daily Mail that his client is not opposed to diversity and inclusion. Largess said Duvall even sat on a committee at the hospital to promote it.

Largess said the facts of the case speak for themselves:

“Mr. Duvall was committed to D&I [diversity and inclusion], sat on a system committee to promote it and his team created marketing materials.

“The case is about the fact that you cannot fire people just to create opportunities to fill positions. It is not a case against diversity and inclusion.”

Another corporation has allegedly created a divisive racial reeducation program that claims “American racism is a uniquely white trait” and encourages employees to promote left-wing causes, such as “reparations,” “defund police” and “trans activism,” according to a report by City Journal.

City Journal’s Christopher F. Rufo obtained a cache of internal documents about AT&T Corporation’s company’s initiative, called Listen Understand Act, which is based on the core principles of critical race theory, including “intersectionality,” “systemic racism,” “white privilege” and “white fragility.”

According to Rufo’s report, CEO John Stankey launched the program last year and reportedly told employees that private corporations such as AT&T have an “obligation to engage on this issue of racial injustice” and push for “systemic reforms in police departments across the country.”

 

Rufo further reported that white employees at AT&T were expected to admit they were both privileged and a part of the racism problem:

“According to a senior employee, who agreed to speak on condition of anonymity, managers at AT&T are now assessed annually on diversity issues, with mandatory participation in programs such as discussion groups, book clubs, mentorship programs, and race reeducation exercises.

“White employees, the source said, are tacitly expected to confess their complicity in ‘white privilege’ and ‘systemic racism,’ or they will be penalized in their performance reviews.

“As part of the overall initiative, employees are asked to sign a loyalty pledge to ‘keep pushing for change,’ with suggested ‘intentions’ such as ‘reading more about systemic racism’ and ‘challenging others’ language that is hateful.’

“‘If you don’t do it,’ the senior employee says, ‘you’re [considered] a racist.’

“AT&T did not respond when asked for comment.”

The first page of AT&T’s Listen Understand Act internal portal encourages employees to study a resource called, “White America, if you want to know who’s responsible for racism, look in the mirror.”

Rufo noted the article’s bizarre claims:

“The article claims that the United States is a ‘racist society’ and lays out its thesis plainly: ‘White people, you are the problem. Regardless of how much you say you detest racism, you are the sole reason it has flourished for centuries.’

“The author, Dahleen Glanton, writes that ‘American racism is a uniquely white trait’ and that ‘Black people cannot be racist.’

“White women, she claims, ‘have been telling lies on black men since they were first brought to America in chains,’ and, along with their white male counterparts, ‘enjoy the opportunities and privileges that white supremacy affords [them].’”

Another resource in the program suggested that the COVID-19 pandemic was helpful in promoting political activism on the racism front, according to Rufo’s report:

“According to the article, written by Andrés Tapia of the consulting firm Korn Ferry, the pandemic has created a ‘brooding sense of always feeling vulnerable’ for white Americans, which has forced them to fear imminent death, which ‘many Blacks live with every day.’

“Furthermore, as millions of Americans have lost their jobs and secured unemployment benefits, they ‘have more time’ to attend street protests, which provided ‘a way to feel like one could have an impact.’

“As a result, Tapia argues, the pandemic established the conditions for a sense of ‘shared helplessness’ that has resulted in political activism.”

In another section, Rufo writes that whiteness is labeled a scam:

“In the ‘Act’ section of the training program, AT&T encourages employees to participate in a ‘21-Day Racial Equity Habit Challenge’ that relies on the concepts of ‘whiteness,’ ‘white privilege,’ and ‘white supremacy.’

“The program instructs AT&T employees to ‘do one action [per day for 21 days] to further [their] understanding of power, privilege, supremacy, oppression, and equity.’

“The challenge begins with a series of lessons on ‘whiteness,’ which claims, among other things, that ‘white supremacy [is] baked into our country’s foundation,’ that ‘Whiteness is one of the biggest and most long-running scams ever perpetrated,’ and that the ‘weaponization of whiteness’ creates a ‘constant barrage of harm’ for minorities.

“The 21-Day Challenge also directs employees to articles and videos promoting fashionable left-wing causes, including ‘reparations,’ ‘defund police,’ and ‘trans activism,’ with further instruction to ‘follow, quote, repost, and retweet’ organizations including the Transgender Training Institute and the National Center for Transgender Equality.”

In response to increased social activism by corporations, Florida Senator Marco Rubio recently introduced the Mind Your Own Business Act.

The new bill seeks to empower shareholders to hold woke corporations accountable.

Zaid Jilani reported:

“Rubio’s bill would put the burden of proof on businesses to prove that any political actions they take part in benefit shareholders and the company.

“If they could not prove that interest, then corporate officers could be held liable.”

William Flaig, who directs a $25 million exchange-traded fund that boycotts firms that endorse liberal causes, stopped short of endorsing the legislation itself, but praised Rubio for starting a debate about woke capital.

Flaig told Jilani:

“I applaud Senator Marco Rubio’s efforts to raise awareness that many companies are actively pushing the liberal agenda and have become hostile to conservative values.

“I have been frustrated watching major corporations support causes that conflict with my conservative ideals, beliefs, and values as well as destroy shareholder value.”
