Can Biden be sued for calling Kyle Rittenhouse a “white supremacist?” History tells us “absolutely”.

KENOSHA, WI- The Babylon Bee is one of the country’s greatest satire sites. This week after the Kyle Rittenhouse verdict, they posted one of their classics, noting that Rittenhouse and Nick Sandmann (the so-called “Covington Kid”) agreed to sharing joint custody of CNN.

This is of course referring to Sandmann’s multi-million dollar lawsuit settlement against the far-left “news” outlet stemming from their slander of him relative to their false reporting over an incident at the Lincoln Memorial in 2019. Sandmann also settled a multi-million defamation suit with the Washington Post.  

Now according to Joel Pollak of Breitbart News, he believes Rittenhouse has a solid defamation case against old dementia boy himself, Joe Biden.

We would argue he’s got a ton of possible defamation suit targets, including Rep. Ayanna Pressley (D-MA), racist Joy Reid of MSNBC, Nichole Wallace also of MSNBC, Don Lemon of CNN and a ton of others. The highest-profile target would be old sleepy Joe himself.

Pollak notes that last year, Biden referred to Kyle Rittenhouse as a “white supremacist” in a tweet while he was a private citizen running for president. That is key because as a private citizen, Biden did not enjoy any type of immunity from lawsuit as he currently does.

At the time of Biden’s tweet, Rittenhouse was, Pollak says, considered to be a so-called “public figure” for the purposes of defamation law, therefore any such suit by the 18-year-old would need to show that any defendant acted with “actual malice”—in other words, reckless disregard for the truth.

In the case of Biden’s statement, which seems to clearly fit the definition of “reckless disregard for the truth.”

Defenders of Biden might argue that on most days Biden doesn’t know what planet he’s on or that he’s the president, therefore he may be able to claim either dementia or simply being clueless.

As a reminder, Biden made the claim last September which was over a month after the Aug. 25 shootings in Kenosha, Wisconsin, for which Rittenhouse had already been charged within a matter of days.

Biden was in the midst of a presidential campaign and was trying to score cheap political points against then-President Donald Trump, who actually waited to weigh in on the shootings until all the facts were out, unlike Biden.

While the mainstream leftist media ran with the narrative that Rittenhouse was some kind of “white supremacist” (despite the victims all being white), claims which had been widely debunked by the end of September, Biden ran with it anyway in a tweet.

Rittenhouse’s legal representatives at the time denied that claim on Aug 28, 2020 and repeated the denial in a subsequent interview with Breitbart News Sunday on SiriusXM Patriot 125.

Pollak notes that presidents are typically “immune from civil lawsuits for torts alleged to have taken place during their time in office.” However a case that sets precedent is the case of Paula Jones versus then-President Bill Clinton.

Jones’s sexual harassment lawsuit against Clinton was allowed to proceed since the incidents happened prior to his taking office.

Therefore based on that case, decided by the Supreme Court, Biden could be sued for defamation by Rittenhouse.

While the young man himself has not tipped his hand regarding a possible lawsuit, his mother may have given some possible intelligence on that when she claimed explicitly that Biden had “defamed” her son—which indicates the possibility of a lawsuit to come.

The fact Rittenhouse was completely exonerated may add fuel to the fire for possible defamation lawsuits by Rittenhouse, added to the fact that at no time during the trial was any evidence presented which showed he had any ties to white supremacy nor did he have any racial animus. The fact that all the victims were white also would seem to debunk any white supremacist motives.

To make matters worse, Biden’s propaganda minister Jen Psaki danced around a question by Fox News’ Peter Doocy about walking back his previous statement and actually doubled—down by tacitly referring to Rittenhouse as a “vigilante,” while not specifically referring to him by name.

Biden also refused to apologize to Rittenhouse after the verdict, and while he initially said the “jury has spoken” and the verdict needed to be accepted, once his far-left handlers got to him he walked back his initial statement and said he was “angry and concerned” by the verdict.

One person who thinks Rittenhouse should sue the news outlets involved is Sandmann himself, according to Fox News. 

Writing in a column for the Daily Mail, Sandmann said Rittenhouse needs to sue in order to “hold the media accountable.” 

“The parallels between me and Kyle Rittenhouse are impossible not to draw,” Sandmann wrote. “The way the media has treated you is terrible and you don’t have to face it alone. 

“Kyle was almost immediately labeled a ‘white supremacists’ and a ‘domestic terrorist.’ To many, my red MAGA hat clearly meant that I was a racist,” Sandmann said.

“Kyle wasn’t given his day in court by his critics. And neither was I. The attacks on Kyle came from the national news media, just as they came for me. They came quickly, without hesitation, because Kyle was an easy target that they could paint in the way they wanted to.” 

Sandmann continued that Rittenhouse went through similar agony as he as the liberal media and political class rushed to judgment. 

“This is the problem with liberal media outlets in the United States. They want to get the story first, get the most views, make the most money, and advance the agenda from liberal patrons,” he wrote.

“These outlets cover themselves when they are wrong with small footnotes at the ends of long articles, clarifying that new information has come out and that they have updated their coverage. News shouldn’t be a scoreboard that constantly changes. News is about coverage that includes a statement of facts that does not need to be corrected. But the liberal media doesn’t do this. The liberal media rushes to be the first to report.” 

Specifically, Sandmann called out Biden, LeBron James and Pressley as well as numerous liberal pundits.

In addressing about Rittenhouse suing for defamation, Sandmann said that while defamation cases can be difficult to win, he believes the road to winning such a suit would be easier since he’s been found innocent of charges. 

“Give it a shot and hold the media accountable,” Sandmann wrote. 

In finishing his column, Sandmann reached out and spoke directly to Kyle Rittenhouse:

“I am here for you and if you ever would like to reach out to me, I am about the only person our age to have an idea of how the media is treating you. The way the media has treated you is terrible, and you don’t have to face it alone.”

CHARLOTTE, NC –  In 2019, Nicholas Sandmann, a student at Kentucky’s Covington Catholic High School went to Washington, DC for a school trip, where the students would be attending an anti-abortion protest. Sandmann got more than he bargained for when a professional protester, Native American activist Nathan Phillips,  tried to goad the then 17-year old into a confrontation.

The viral video showed Nick standing his ground, wearing a MAGA hat, smile on his face as Philips beat a drum in front of him. Liberals slammed Sandmann, claiming that he was “getting in the face” of Phillips.

He was subjected to scorn and ridicule, with one pundit, former CNN host Reza Aslan claiming that Sandmann had a “punchable face.” On Tuesday, Sandmann found himself on the national stage once again, this time at the Republican National Convention.

Apparently, CNN has not learned its lesson. Sandmann famously won a multi-million defamation settlement from the DNC state-run network. On Tuesday, following Sandmann’s speech at the RNC, CNN political analyst and former Clinton administration press secretary lashed out at Sandmann once again.

On Twitter, Lockhart said:

I’m watching tonight because it’s important. But I don’t have to watch this snot nose entitled kid from Kentucky.”

Hmmm. Seems like old Joe might be a little bit jealous that Nick Sandmann probably now is worth more than he would ever hope to be.

Lockhart wasn’t the only one who was triggered by Sandmann’s appearance. Some goober named Benjamin O’Keefe, who used to be on the staff of Sen. Elizabeth Warren, as well as way-left organization, Move On,  also attacked Sandmann during his speech, mocking his physical appearance. Judging by O’Keefe’s own profile picture, he has little room to talk.

O’Keefe is also apparently a little, shall we say “sensitive.” When he was called out on Twitter by a woman named @AmandaPresto, he deleted the tweet and then blocked her. Fortunately, she grabbed a screen shot of the gutless O’Keefe’s tweet.

Oh, and O’Keefe is also pretty confused along with being sensitive. His bio apparently said he was a “trans-inclusive intersectional feminist” with he/him/his pronouns.” 

After the initial video went viral, Sandmann became a target of the far left, with all of the state-run DNC media (CNN, MSNBC, Washington Post, New York Times) all slamming him without having the facts.

When the facts came out, it was much different than what was portrayed by the left, and Sandmann sued numerous media outlets. He also sued Sen. Elizabeth Warren, however that suit was dismissed because as a sitting U.S. Senator, Warren cannot be sued due to qualified immunity.

Interesting: Didn’t Warren want that taken away from police officers?

Sandmann and his fellow classmates were called racists by people, with claims coming out that it was they who were taunting Phillips and his fellow demonstrators by blocking their movement at the Lincoln Memorial.

As happens, additional footage of the incident was released, which showed that the situation was far more involved than what was being reported by the left-wing, anti-Trump media.

It was revealed that there was, yet a third group involved in the incident, whose members had been instigating the situation, shouting insults at both groups. It was shown that Sandmann had not been the one who instigated a confrontation.

In his speech at the RNC, Sandmann slammed the media while claiming that they were fine with ruining a teenager’s life to score cheap political points with their base. He also addressed the so-called “cancel culture,” where people are afraid to speak out and express their opinions for fear of being “cancelled.”

Sandmann said:

“I learned what was happening to me had a name, it was called being cancelled. Cancelled is what’s happening to people around this country who refuse to be silenced by the far left. Many are being fired, humiliated, or even threatened.”

He went on to say that he had “fought back hard to expose the media for what they did to me,” while saying that he had “won a personal victory,” believed to be an inference to winning lawsuits against both the Washington Post and CNN. Both suits were settled for undisclosed amounts.

Here is the bulk of Sandmann’s speech:

“Being from Kentucky, the birthplace of Abraham Lincoln, my classmates and I visited the Lincoln Memorial. I found myself face-to-face with Nathan Phillips and other professional protesters looking to turn me into the latest poster child showing why Trump is bad. While the media portrayed me as the aggressor with a “relentless smirk” on my face, in reality the video confirms I was standing with my hands behind my back and an awkward smile on my face that hid two thoughts: One, don’t do anything that might further agitate the man banging a drum in my face and two, trying to follow a family friend’s advice never to do anything to embarrass your family, your school, and your community.

“Before I knew what was happening, it was over. One of Mr. Phillips fellow agitators yelled out, “We got him!,” “It’s all right her on video,” and “We won Grandpa.” What I though was a strange encounter quickly developed into a major news story, complete with video footage.

“My life changed forever in that one moment. The full war machine of the mainstream media revved up into attack mode. They did so without ever researching the full video of the incident; without ever investigating Mr. Phillips’ motives; or without ever asking me for my side of the story. And do you know why? Because the truth wasn’t important. Advancing their anti-Christian, anti-Conservative, anti-Donald Trump narrative was all that mattered. And if advancing their narrative ruined the reputation and future of a teenager from Covington, Kentucky…so be it. That will teach him not to wear a MAGA hat!”

Sandmann finished with this:

“I know that you’ll agree with me when we say that no one in this country has been a victim of unfair media coverage more than President Donald Trump. And one more thing, let’s Make America Great Again!”
