ERO Boston arrests Brazilian illegal immigrant who has been charged with several child sex crimes

LOWELL, MA - On Friday, April 12th, Enforcement and Removal Operations (ERO) officers in Boston announced the arrest of an illegal immigrant from Brazil who has been accused of several child sex offenses in the state of Massachusetts. 

According to the press release, deportation officers from ERO Boston arrested the 53-year-old on March 28th near his residence in Revere. ERO Boston Field Office Director Todd M. Lyons said in a statement, "This Brazilian national has been charged with some horrific and disturbing crimes. This is certainly not the type of person that we want interacting freely with the children of our neighborhoods. ERO Boston will continue to work tirelessly to arrest and remove noncitizen child sex predators from our New England communities."

The illegal immigrant was admitted to the United States in Miami, Florida, back on September 6, 2001, as a non-immigrant with authorization to remain in the country until March 5, 2002. He failed to leave the country by that date and on March 27, 2007, was encountered by ERO after an investigation conducted by the Everett Police Department and the U.S. Postal Service. 

According to Immigration and Customs Enforcement (ICE), at that time, the illegal immigrant was, "deemed removable pursuant to the Immigration and National Act and placed into removal proceedings." On April 5, 2007, he bonded out of ERO custody pending removal proceedings. On February 12, 2008, a Department of Justice (DOJ) immigration judge in Boston granted the illegal immigrant voluntary departure from the U.S. to Brazil. He was given until June 11, 2008, to leave.

The press release said that, "he voluntarily departed the country on June 6, 2008, but then unlawfully reentered the United States on an unknown date and at an unknown location without being inspected, admitted or paroled by a U.S. immigration official. On December 20, 2021, the Everett Police Department arrested him for indecent assault and battery on a child and rape of a child". 

He was booked into the Middlesex County House of Corrections and within hours the ICE Pacific Enforcement Response Center (PERC) lodged an immigration detainer request with the prison and to be notified in advance of his release. 

On April 7, 2022, the illegal immigrant was arraigned at the Middlesex County Superior Court after being indicted for five counts of aggravated rape of a child by joint enterprise; one count of aggravated rape of a child, five year age difference; four counts of aggravated rape of a child, 10 year age difference; one count of indecent assault and battery on a child under 14; and one count of obscene material to a minor.

The Middlesex County Superior Court did not honor the ERO's request and released the illegal immigrant from custody on November 23, 2022. He was not arrested by ERO Boston until March 28, 2024, nearly two years later. 

According to NBC 15, ignored detainers have become a frequent concern. Earlier in April, Rep. Nicole Malliotakis (R-NY) blasted New York City leaders over their failures to work with ICE officials in removing illegal immigrants from the city.

Rep. Malliotakis said, "Instead of working with federal officials to arrest, detain and immediately deport thugs wreaking havoc in our city, progressive politicians have tied the hands of our NYPD to the benefit of criminals and are allowing them to remain here in luxury hotel rooms with five-star service on the taxpayers' dime."
